EOI vs Reservation in Dubai Off-Plan Property: What Changes?

An expression of interest records a buyer's interest under a project's stated terms. A reservation is a later, more specific commercial step involving an identified unit and the developer's conditions. Neither label should be treated as proof of a signed sale agreement or registered ownership.

Dubai off-plan launches often use these terms alongside “booking” and “hold,” sometimes inconsistently. For buyers, brokers and sales teams, the safest operational habit is to ask what evidence and obligations changed—not merely what a dashboard now calls the record.

The five records you should keep distinct

Registration and legal ownership are further matters governed by the applicable process. A CRM's “won” status does not perform government registration.

What an EOI can and cannot establish

Depending on the project, an EOI may register demand, support a priority process or relate to a proposed unit. The developer's written terms determine whether a payment is required and what happens next.

Do not assume that payment guarantees allocation, that all EOIs are free, or that every EOI is refundable. A buyer should understand what they are requesting, who receives the payment if one applies, and which outcome triggers refund or credit toward the next stage.

The industry's shorthand can obscure these distinctions. Ask for the actual terms rather than relying on a social post that says “secure your unit.” Promotional material should explain the stage honestly.

What changes at reservation

At reservation, the operational record should identify the unit, the intended buyer parties, the accepted price and the relevant conditions. The developer's authorized approval should be distinguishable from the broker's submission.

Availability must be checked at the time of the action. Two buyers may have seen the same unit earlier, so an old availability screen cannot establish who has a valid reservation now. A hold can support that process, but it needs an owner and expiry; an expired hold is not an ongoing entitlement.

Before acknowledging a reservation, confirm whether required documents, acknowledgement and funding evidence have been received. Record outstanding items explicitly. Do not mark a document signed simply because somebody uploaded a file with “signed” in its name.

Worked example: crediting an EOI deposit once

Suppose an illustrative unit price is AED 2,000,000 and the accepted booking requirement is 10%, or AED 200,000. The buyer previously paid an AED 20,000 EOI deposit.

If the written terms say the EOI deposit is credited toward booking, the remaining booking amount is AED 180,000, not AED 200,000. The total booking funding remains AED 200,000; the deposit is not an additional discount or a second instalment.

This example excludes taxes and other fees and is not a market-standard deposit schedule. If the project terms treat the deposit differently, follow those terms. Confirm who received the funds and retain the receipt and application evidence.

A buyer can be more than one person

A buyer record may involve joint purchasers, a company and an authorized signatory, or a representative acting for someone else. Distinguish the legal party from the person communicating with the sales team.

Record the relevant parties and authority before generating an agreement. Do not substitute a salesperson's contact for the buyer or assume that the first contact attached to a company can sign for it. Our real-estate systems research repeatedly found that these relationship distinctions matter as the deal progresses.

Only collect the information necessary for the stage and protect identity documents through the authorized process. A broker's access to project material does not grant access to unrelated buyers' records.

Check refund and cancellation terms before submission

The written terms should answer:

  • What happens if no unit is allocated?
  • What happens if the developer rejects the request?
  • What happens if the buyer withdraws?
  • Which deadlines or conditions change the outcome?
  • How is a refund requested and evidenced?
  • Does the deposit carry forward to an accepted booking?

Do not publish a universal refund promise based on another development's practice. Contractual and legal questions should be checked against the project's documents and the relevant official requirements.

Frequently asked questions

Does an EOI guarantee a specific property unit?

Not by itself. An EOI records interest under the project's terms. A specific allocation or reservation requires the relevant developer confirmation and conditions.

Are all off-plan EOIs refundable?

No universal refund rule should be assumed. Check the written terms for the project, including withdrawal, rejection, allocation failure, deadlines and the process for requesting a refund.

Is a reservation the same as a signed SPA or registered ownership?

No. Reservation, sale agreement and registration are distinct stages. Their legal effect depends on the documents and applicable process, not simply the status label in a CRM.
